SINGPOST OFFERS THIS SERVICE TO vPOST MEMBERS BASED ON THE
TERMS AND CONDITIONS SET OUT BELOW. YOU ARE DEEMED TO HAVE ACCEPTED THESE TERMS
AND CONDITIONS BY USING THIS SERVICE AS A vPOST MEMBER.
1.
DEFINITIONS
“vPOST” refers to a service
provided by SingPost which includes but is not limited to, the provision of
online presentment and/or payment of bills, invoices and renewal of policies on
behalf of service providers, shipping and shopping services as well as other
services that may be introduced from time to time. This service is accessible
from the URL http://www.vpost.com ,
including such features thereof as may be delivered therefrom.
“vPOSTUSA”,
“vPOSTJAPAN” or “vPOSTEUROPE” refers to a service provided by vPOST which
allows vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE customers to shop at eligible U.S, Japan
or European Merchant’s websites and have their Items delivered to their vPOST
local mailing/delivery address.
“vPOSTUSA
address”, “vPOSTJAPAN address” or “vPOSTEUROPE address” refers to the overseas
address as provided by vPOST. vPOST may at its discretion change this address
or add new addresses from time to time.
“Merchant” refers
to any U.S, Japan or European organization, which allows the use of a locally
issued credit card and provides the sale of non-prohibited Items.
“GST” refers to goods and services tax,
which expression includes any tax, by whatever name called, of a similar nature
that may be substituted for it of levied in addition to it.
“Member” means
the registered vPOST member, whose personal particulars and address are as
registered with SingPost at the vPOST website.
“Shipment” means
the Item(s) being shipped by sea, air or land in any combination, between the
Merchant(s), SingPost and You.
“Item” means the actual physical
package containing the actual content(s) being shipped or received, as the case
may be, by the Merchant(s), SingPost and You.
“Our,”
“We,” “Us” and “SingPost” refers to Singapore Post Limited (Reg No.
199201623M).
“You”
and “Your” refers to the Member using this service.
Title headings
are inserted for convenient reference only and shall not affect the
interpretation of the substantive provisions of these Terms and Conditions.
2.
PAYMENT
2.1 You shall
promptly confirm and pay any vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE charges by the
stipulated schedule as specified by SingPost which includes but not limited to the following components:
(a) Shipping
charges;
(b) GST and
Customs GST prevailing from time to time, if applicable;
(c) Holding fee
of S$10.00 (Singapore Dollars Ten) per week or part thereof per
Item, should the Item be held by SingPost for more than seven (7) days;
(d) Penalty fee
of S$10.00 (Singapore Dollars Ten) per week or part thereof
per Item, should Your invoice not be
received by SingPost for more than seven
(7) days from the date it arrived at the vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE
address;
(e) Any additional
shipping charges, should the Item not comply with the specified guidelines for
delivery as specified at http://www.speedpost.com.sg/UsefulinformationServiceguide.html , in order to process the Shipment of the Item(s) to You; and
(f) Any other
charges, if applicable, in order to process the Shipment of the Item(s) to You.
2.2 You shall
promptly pay for any Customs duty and any other applicable charges imposed by
any local or government authority of Singapore or destination country, before
the Item is delivered to Your local mailing/delivery address.
2.3 Only payment
via the vPOST website will be accepted.
2.4 All payment
must be made in full. SingPost may detain the Item for which such payment has
not been made in full until such time full payment is made.
2.5 We do not
accept any request for any payments to be split for one (1) or more Items in
one (1) or more Shipments.
2.6 You shall
compensate Us for the cost of the storage of the said Item, Shipment charges,
storage charges, duties and taxes incurred by Us, and all claims, damages,
fines and expenses incurred if the Shipment/Item is deemed prohibited,
dangerous and illegal . We reserves the right to dispose the Item in any manner
we deem fit, if You fail to make payment of all charges within thirty (30) days
of notification to do so.
3.
CHARGES
3.1 The Shipping
charges will cover handling, overseas shipping and local delivery from the
vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE address to Your local mailing/delivery

3.2 We will have
the right to review the Shipping charges from time to time and make changes
thereof without any or prior notice to You.
3.3 You
acknowledge that all dutiable Items imported into Singapore are subject to Customs
duty and/or excise duty in accordance with the Schedule to the Singapore
Customs Duties Order. The broad categories of dutiable Items in Singapore
include but are not limited to, intoxicating liquors, tobacco products, motor
vehicles and petroleum products.
3.4 For all
Items shipped under the vPOSTUSA and vPOSTJAPAN service and categorised under
'Others', Shipping charges will be imposed based on a minimum weight of 0.5
kilograms.
3.5 For all
Items shipped under the vPOSTEUROPE service and categorised under ‘Others’,
Shipping charges will be imposed based on a minimum weight of 1.0 kilograms.
3.6 The Shipping
charges are calculated in accordance with “Shipping Charges” at https://www.vpostasia.com/australia/vpostusa/usa_shipcharge.htm
for vPOSTUSA or https://www.vpostasia.com/australia/vpostjapan/japan_shipcharge.htm
for vPOSTJAPAN or https://www.vpostasia.com/australia/vposteurope/europe_shipcharge.htm
for vPOSTEUROPE, as may be amended from time to time and based on how the Item
has been packed by Your Merchant.
4.
MEMBER’S RESPONSIBILITY
4.1 You are
eligible to use the vPOST service offered only if the following conditions are
satisfied:
(a) You agree to
abide by and comply with these Terms and Conditions for Shipping at all times,
(b) You agree to
abide by and comply with the Terms and Conditions for Registration as a vPOST
Member at all times,
(c) You have
provided all information We require in connection with Your registration, and
that accurate and complete information is provided.
4.2 You shall ensure
that Items purchased from Merchant’s website are not articles prohibited by
Singapore government and under any law in force in the Republic of Singapore, the
country of origin and/or the country of destination.
4.3 You grant Us
the right to disclose specific information as required by any applicable law,
direction of a statutory regulator or stock exchange or pursuant to a court
order.
4.4 Upon Your purchase
of the Item at the Merchant’s website, You shall indicate as Your shipping address,
your vPOST account number (VP) and the vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE address.
You may login to vPOST to view the applicable shipping address.
4.5
Subject to clause 4.4, incomplete or erroneous information provided by You or
Your Merchant may result in loss or delay in the delivery of Your Item to the
provided vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE address.
4.6 We reserve
the right to discard and/or dispose of the Item in any manner We deem fit
without being liable to You, if We are unable to process the Item within thirty
(30) days of the Shipment being received at the vPOSTUSA, vPOSTJAPAN or
vPOSTEUROPE address, for any reason.
4.7 You shall pay
directly to the Merchant for Your purchase at the Merchant’s website. This
includes the price of Your Item, handling and local domestic shipment charge
and all applicable sales tax.
4.8 You shall promptly
pay all amounts in full due to SingPost via the vPOST website.
4.9 You shall be
liable to Us and indemnify and keep Us indemnified at all times from and
against all demands, claims, action or proceedings by whomsoever made or preferred
and against all damages, costs, charges or expenses (including reasonable legal
costs) incurred, suffered or sustained by Us in connection with the service
performed for You.
5. OUR
RESPONSIBILITY
5.1 We will
notify You of the amount You have to pay for Shipping charges, Customs GST (if
applicable) and any other applicable charge as referred at Clause 2.1. In
providing the Shipment service, We act as an independent contractor and We are
not an agent of any Merchant(s) or in any other capacity unless otherwise
specifically stated.
6.
CUSTOMS REGULATIONS, HAZARDOUS MATERIALS, DANGEROUS GOODS, PROHIBITED OR
RESTRICTED ARTICLES
6.1 It is Your
responsibility to enquire into and comply with import and export regulations
for the origin and destination country.
6.2 You should
refer to the website set up by the government authorities of the country of
origin and/or destination for up-to-date information on Customs and regulations
regarding hazardous material, dangerous goods, prohibited or restricted
articles, and any other regulatory issue that affects the Shipment.
6.3 You agree
that Your Item or Shipment is deemed unacceptable if:
(a) No Customs
declaration is made when required by applicable Customs regulations, and
(b) It is classified as
hazardous material, dangerous goods, prohibited or restricted articles by IATA
(International Air Transport Association), ICAO (International Civil Aviation
Organization), any applicable government department or other relevant
organization of the country of origin and/or the destination country.
6.4 You shall be
liable for any loss or damage suffered by any third party as a result of a
breach of this clause.
6.5 Subject to
clause 6.3, You may also check here to view a list of such unacceptable Item(s) which are
currently notified to Us by the relevant authorities. This list may be amended by the relevant authorities from time to
time.
6.6 You
acknowledge that additional charges are applicable for re-direction of the
Item, made at Your request, to another address other than the local
mailing/delivery address provided under Your vPOST profile, if the Item is
deemed unacceptable for import to the destination country. You will be notified
of these additional charges as they become due and payable by You.
7.
DELIVERY
7.1 All Item(s)
will only be delivered to one (1) local mailing/delivery address as stated in
Your vPOST profile.
7.2 We shall
make reasonable effort to deliver the Item to You within the stipulated
delivery time frame indicated here from the date of full payment for the charges as notified to You. High security
addresses or addresses in more remote locations may require a longer delivery
time. There will be no deliveries on Saturday afternoons, Sunday and gazetted
public holidays. We shall however not be liable (whether in contract, tort or
otherwise) for any delay in effecting delivery of such Items for whatever
reasons.
7.3 We will have
the right to refuse delivery if any amount owing to Us is not paid in full.
7.4 Item(s)
shall be delivered to the local mailing/delivery address as registered on Your
vPOST profile by You, but not necessarily to the named Member personally.
Shipment shall not be made to PO boxes.
7.5 Shipment of
Items exceeding twenty (20) kilograms in either volumetric or actual weight
will be shipped only after the Item has arrived at the vPOSTUSA, vPOSTJAPAN or
vPOSTEUROPE addresses and after payment has been made in full accordingly.
7.6 You agree
that the actual/volumetric weight of Your Item may generally vary between 0.001
kilograms to 0.5 kilograms.
7.7 You
acknowledge and agree that Singapore Customs and/or destination country’s local
Customs Authority has the right to detain any Item for whatsoever reason they
deem appropriate, and that We are not liable for any consequences of such
delay.
7.8 You may
login into Your vPOST account to check the delivery status of the Item.
7.9 Upon
receipt of the Shipment or Item, You are advised to check that the Item has
been received in good order.
7.10 We may, at
Our sole discretion, perform any of the following activities on behalf of You
in order to facilitate the Shipment of Your Item;
(a) complete any
documents required under applicable laws and regulations,
(b) act as Your
forwarding agent for Customs and export control purposes and as a receiver
solely for the purpose of designating a Customs broker to perform Customs
clearance and entry, and
(c) re-direct the
Shipment to another address upon request by You.
7.11 We have the right to withhold delivery if any amount owing
has not been paid in full.
7.12 For any
unsuccessful delivery within Singapore, You will be advised through a card left
at the address supplied by You to contact SingPost for further delivery
arrangements. For any unsuccessful
delivery outside Singapore, You will be advised for further delivery arrangements
as per Your country’s current delivery policy.
7.13
Notwithstanding any arrangements You may have with the Merchant for any
cancellations, refunds, returns or exchanges, We will proceed to ship the Item
to You once we processed the Item and assigned the VS/EV shipment number for
that Item.
8.
RESTRICTED AREA
8.1 There is no
delivery to any restricted areas as defined by the country of destination.
9.
CLEARANCE OF ITEMS
9.1 All Item(s)
imported into Singapore are subjected to Customs clearance at Singapore Post
Centre (SPC).
9.2 You
acknowledge that Customs at SPC will detain dutiable Items. You will be
informed of the status of the Item by a letter of notification from Us or from
the Customs Authority. The Item may be released after examination by Customs at
SPC in the presence of You or Your representative and on payment of any charges
deemed appropriate by Customs.
9.3 You
acknowledge that import of controlled Items in the Shipment requires the
approval from the relevant controlling authority. Items requiring approval from
relevant controlling authority will be detained by Customs at SPC. You will be
notified to obtain an import licence from the controlling authority concerned.
Upon presentation of the licence and payment of any charges to Customs at SPC,
the Item may be released.
9.4 When using vPOSTUSA
shipping service, for Shipment or Item above USD2500 (two thousand and five
hundred United States Dollars), please fill up the Shipper’s Export Declaration
(SED) form. Click here for the sample form. Please ensure that all
information is correctly entered to ensure smooth delivery of the Item from US
to Your destination country. Please refer to this URL http://www.census.gov/foreign-trade/regulations/forms/new-7525v.pdf.
Kindly print out the form and fax to SingPost.
10.
UNCLAIMED DELIVERIES
10.1 If You
refuse delivery or refuse to pay for delivery, or the Shipment or Item is
deemed unacceptable for any reason, We may at our sole discretion:
(a) Where appropriate,
contact You and agree on appropriate action to take, or
(b) use reasonable
efforts to return the Item to Vendor at Your cost.
11.
SHIPMENT RETURN
11.1 As We only
provide for Your Item to be shipped from the vPOSTUSA, vPOSTJAPAN or
vPOSTEUROPE address to Your local mailing/delivery address, We shall not in any
way be involved or concerned with any claim for refund, return, rebate or
exchange of Your Item(s) in the Shipment. For all such Item(s), You will need
to liaise and deal directly with the Merchant for any refunds, returns,
exchange, rebates and money-back guarantee policy and/or procedures. All
refund, returns, exchange, rebates and money-back guarantee policies and
procedure will be in accordance to the Merchant’s policies and procedures.
11.2 For return
of Item, You will need to provide Your own arrangement to send the Item back to
the Merchant, and at your own cost.
11.3 In the case
of exchange, You will provide Your own arrangement to send the Item back to the
Merchant, and pay for the subsequent charges in order to have the Item returned
to the local mailing/delivery address as specified by You.
11.4 Subject to
clause 7.14, You acknowledge that you will need to provide Your own arrangement
to send the Item back to the Merchant for Shipment of any Item(s) that We have
processed and assigned a VS/EV shipment number to.
12.
INSPECTION OF ITEM(S) IN SHIPMENT
12.1 We may, at
Our sole discretion but not be obliged to, open and inspect for any reason the
Item(s) in the Shipment.
13.
LIMITATION OF LIABILITY
13.1 We shall
not be liable for all indirect, ancillary or consequential loss or damage,
including but not limited to the loss of profits, business and anticipated
savings, even if the risk of such loss or damage was brought to Our attention
before or after acceptance of the Shipment, including Our failure to perform
any of Our obligations hereunder as a result of circumstances outside Our
control including but not limited to the outbreak of war, any governmental act,
explosion, accident, civil commotion, riot, industrial dispute, strike,
lockout, stoppages or restraint of labour from whatever cause whether partial
or general, weather conditions, traffic congestion, mechanical breakdown, obstruction
of any mode of transport or other force majeure, including fire, flood or any
acts of God.
13.2 On the
condition that We are satisfied that Your claim of loss or damage to the
Shipment or Item or contents thereof is justified, Our liability for loss of or
damage to Your Item or its contents thereof shall be limited to the following
sums:
(a) S$60 (Singapore
Dollars sixty) per Item, or the declared value of the Item, whichever is lower,
for Singapore as the country of destination, or
(b) S$150 (Singapore
Dollars one hundred and fifty) per Item or the declared value of the Item,
whichever is lower, for any other country as the country of destination.
13.3 Claims are
limited to one claim per Item, settlement of which will be full and final settlement
for all loss or damage in connection therewith. All such claims must be made
within three (3) days from the date Your Item was delivered to You. We reserve
the right to reject any claim(s) if they are not made by You within the
stipulated time.
13.4 Warsaw
Convention
If the Shipment
or Item is transported by air and involves an ultimate destination or stop in a
country other than the country of departure, the Warsaw Convention, if
applicable, governs and in most cases limits Our liability for loss or damage.
13.5 Insurance
You may purchase
additional insurance. You must make a
special declaration of value and request insurance or make Your own insurance
arrangements, failing which You assume all risks of loss or damage. Click here to obtain information on how to purchase additional
insurance for Your Item.
14.
LOSS, DAMAGE AND DELAY TO SHIPMENT
We shall not in
any case be liable for any loss, damage and delay of Shipment arising:
14.1 from any
defect in any Item(s) in the Shipment, whether or not known to Us at any time
before delivery to You,
14.2 from
incomplete, insufficient, or erroneous entry of the vPOSTUSA, vPOSTJAPAN or
vPOSTEUROPE address by You at the Merchant’s website,
14.3 from
failure by the Merchant to make delivery within a reasonable time to the vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE
addresses,
14.4 from
failure by any party to make an accurate declaration for Customs, regulatory
and delivery purposes,
14.5 from
insufficient or improper packing or addressing information of the Item(s) in
the Shipment by Your Merchant,
14.6 from
improper packing of the Item(s) in the Shipment after having been opened by Us
for verification whether at the request of Customs or other governmental
agencies,
14.7 from
insufficient or improper packing of the Item(s) in the Shipment after having
been re-packed by Us at Your request,
14.8 from any
alleged delivery from the Merchant to the vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE address
provided by you, where there is no proof
of delivery furnished by the Merchant or their delivery agent and where the
receipt of the Item is not signed and acknowledged by the vPOSTUSA, vPOSTJAPAN
or VPOSTEUROPE addresses.
14.9 from any loss
of secrecy in communications arising during the Shipment,
14.10 electrical
or magnetic damage to, or erasure of electronic or photographic images or
recordings,
14.11 from the
hazardous, fragile or brittle nature or the mechanical derangement of the Item(s)
in the Shipment,
14.12 failure by
You to take delivery of the Shipment within thirty (30) days from notification
of delivery:
(a) As a consequence of
delay or confiscation by any competent authority as a result of the discovery
of prohibited goods or dangerous Items, and
(b) from failure by the
Merchant to provide incomplete, insufficient, or erroneous information on Your
Shipment Item to vPOSTUSA, vPOSTJAPAN or vPOSTEUROPE.

INDEMNITY
15.1 You shall
indemnify and keep Us indemnified at all times from and against all demands,
claims, actions, proceedings, costs charges and expenses including but not
limited to Customs and other regulatory penalties, storage charges, retrieval
and administrative costs, duties and taxes (including reasonable costs)
incurred, suffered or sustained by Us in connection with the Shipment service
performed for You, and pay Us damages, costs and interest in connection with
such claim, action, suit or proceeding.
16.
NOTICES AND CLAIMS
16.1 Any
notices, demands or any other correspondences whatsoever shall be deemed to be
communicated to You if the same is sent by ordinary post or email to the
address provided under Your vPOST profile, or such other address as informed to
Us in writing prior to the dispatching of any notices, demands or any other
correspondences whatsoever. All notices or correspondences from You to Us must
be in writing and sent to Us at the address stated in this clause.
16.2 All claims
for loss or damage must be made within three (3) days from the date of
delivery, failing which We shall have no liability whatsoever. Such claims must
be made in writing, accompanied by the original copy of the consignment note,
any supporting documents, relevant invoices or receipts for that Item and
should be submitted to:

17.1 These Terms
& Conditions, the service, the information on this website and use of all
related facilities are provided on an "as is, as available" basis
without any warranties whether express or implied.
17.2 To the
fullest extent permitted by applicable law, We disclaim all representations and
warranties relating to this website and its contents, including in relation to
any inaccuracies or omissions, warranties of merchantability, quality, fitness
for a particular purpose, accuracy, availability, non-infringement or implied
warranties from course of dealing or usage of trade.
17.3 While We
may use reasonable efforts to include accurate and up-to-date information on
this website, We make no warranties or representations as to its accuracy,
timeliness or completeness.
17.4 WE SHALL
NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR
PUNITIVE DAMAGES, HOWSOEVER CAUSED, RESULTING FROM YOUR ACCESS TO, USE OF OR
INABILITY TO USE, RELIANCE ON INFORMATION ON THIS WEBSITE, OR ANY DELAYS,
INACCURACIES IN THE INFORMATION OR IN ITS TRANSMISSION INCLUDING BUT NOT
LIMITED TO DAMAGES FOR LOSS OF BUSINESS OR PROFITS, USE, DATA OR OTHER
INTANGIBLE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
17.5 The above
exclusions and limitations apply only to the extent permitted by law. None of
Your statutory rights as a consumer that cannot be excluded or limited are
affected.
18.
TERMINATION BY US
18.1 We reserve
the right to terminate or suspend this service at any time without assigning
any reason.
18.2 Without
prejudice to the generality of the foregoing, We reserve the right to terminate
or suspend Your use of this service if:
(a) there is
abuse or misuse of the service by You; or
(b) we are of
the reasonable opinion that You have breached any of the terms and conditions
herein contained.
18.3 We shall
not be liable to You or to any other party for any damages, losses, cost or
expenses howsoever caused by or arising out of such termination or suspension.
19.
TERMINATION BY YOU
19.1 You may
terminate use of this service by giving Us at least one (1) calendar month’s
prior notice in writing to Our address in clause 16, and/or via email to Us for
vPOSTUSA or vPOSTJAPAN or vPOSTEUROPE service.
19.2 Your
termination of use of this service shall not release You from any liabilities
or responsibilities which have accrued prior to the date of termination,
including but not limited to Your obligation to pay any outstanding charges.
20.
ASSIGNMENT AND SUB-CONTRACT
20.1 We have the
right to assign or transfer or sub-contract all or part of its rights or
obligations hereunder at Our discretion.
21.
AMENDMENTS
21.1 We reserve
the right to modify these Terms & Conditions from time to time without
notice. The revised terms and conditions will be posted on this website and
shall take effect from the date of such posting. We assume no liability or
responsibility for any errors or omissions in the content of these Terms &
Conditions.
22.
APPLICABLE LAW AND JURISDICTION
22.1 We may be
accessed from all countries around the world where the local technology
permits. As each of these places have differing laws, by accessing this website
both We and You agree that the laws of the Republic of Singapore, without
regard to the conflicts of laws principles thereof, will apply to all matters
relating to these Terms & Conditions.
22.2
We and You accept and agree that for Our benefit, We and You hereby submit to
the exclusive jurisdiction of the courts of the Republic of Singapore in
respect of any dispute or difference arising out of and/or in connection with
this Agreement with the right reserved to Us to initiate proceedings in the
courts of any other country having or exercising jurisdiction on such dispute
or difference. |
